The Worst Traffic Tickets You Can Receive

Written By: Benjamin Goldman, Esq.

(1) Driving without Insurance. Many people do not believe this but in fact this may be the worst ticket you can get. VTL 319-1 prohibits driving a vehicle that is not insured. It does not matter if you are not the owner of the vehicle or you had no idea the car was not insured. The idea is that when you are driving a car it is your responsibility to confirm that the car complies with New York state law before you drive the car. There is a maximum fine of $1593.00 and you will have to pay a $750 civil penalty. Most importantly, your license will be revoked for at least a year.

(2) Reckless Driving. This is a 5-point ticket and has a maximum fine of $393 for a first offense. This is the only “points” violation that is also a criminal charge. If you are convicted of Reckless Driving you will have a criminal record.

(3) Speeding more than 40 miles per hour over the limit. The highest point total for a ticket is 11 points. This is reserved for motorists clocked at speeds 41 miles per hour over the limit. Judges in town and village courts have the discretion to impose a jail sentence of 15 days for such speeds. The fines and fees combined can reach $1368. The fines and fees are higher with previous violations on your record. Most importantly, 11 points will get you suspended.
